She was bought and sold like camels alongside her male counterparts; they were the slaves of pre Islamic Arabia.
However contrary to the male slaves she was used by her masters for personal sexual gratification and also during trade season the rich and famous non-Muslim men of Arabia would pitch tents outside the city for their female slaves and each of the tent had their flag proclaiming ownership. Trades were made and rewards or bribes were exchanged by the sexual use of female slaves.
When Islam began to spread in the Arab tribes, the command came for Muslims to earn Jannah and many hasanaat by releasing their slaves and teaching them Islam. At the same time, protection and help in setting them up in trade or a job was advocated to avert a glut of humans without work (as was seen in the south in the US after the civil war) who would then turn to wrong or violent methods to earn their living. Easing the freedom of humans was the method that Islam advocated with the goodwill and guidance of the owner to find them a good position in society in order to live a clean life.
When the women who were being used as sexual slaves heard of this, some of them came to RasullAllah pbuh and asked him “what about us?” at which time these ayahs were revealed:
بِسۡمِ ٱللهِ ٱلرَّحۡمَـٰنِ ٱلرَّحِيمِ
وَأَنكِحُواْ ٱلۡأَيَـٰمَىٰ مِنكُمۡ وَٱلصَّـٰلِحِينَ مِنۡ عِبَادِكُمۡ وَإِمَآٮِٕڪُمۡۚ إِن يَكُونُواْ فُقَرَآءَ يُغۡنِهِمُ ٱللَّهُ مِن فَضۡلِهِۦۗ وَٱللَّهُ وَٲسِعٌ عَلِيمٌ۬ (٣٢) وَلۡيَسۡتَعۡفِفِ ٱلَّذِينَ لَا يَجِدُونَ نِكَاحًا حَتَّىٰ يُغۡنِيَہُمُ ٱللَّهُ مِن فَضۡلِهِۦۗ وَٱلَّذِينَ يَبۡتَغُونَ ٱلۡكِتَـٰبَ مِمَّا مَلَكَتۡ أَيۡمَـٰنُكُمۡ فَكَاتِبُوهُمۡ إِنۡ عَلِمۡتُمۡ فِيہِمۡ خَيۡرً۬اۖ وَءَاتُوهُم مِّن مَّالِ ٱللَّهِ ٱلَّذِىٓ ءَاتَٮٰكُمۡۚ وَلَا تُكۡرِهُواْ فَتَيَـٰتِكُمۡ عَلَى ٱلۡبِغَآءِ إِنۡ أَرَدۡنَ تَحَصُّنً۬ا لِّتَبۡتَغُواْ عَرَضَ ٱلۡحَيَوٰةِ ٱلدُّنۡيَاۚ وَمَن يُكۡرِههُّنَّ فَإِنَّ ٱللَّهَ مِنۢ بَعۡدِ إِكۡرَٲهِهِنَّ غَفُورٌ۬ رَّحِيمٌ۬ (٣٣) وَلَقَدۡ أَنزَلۡنَآ إِلَيۡكُمۡ ءَايَـٰتٍ۬ مُّبَيِّنَـٰتٍ۬ وَمَثَلاً۬ مِّنَ ٱلَّذِينَ خَلَوۡاْ مِن قَبۡلِكُمۡ وَمَوۡعِظَةً۬ لِّلۡمُتَّقِينَ (٣٤)
And marry such of you, as are solitary and the pious of your slaves and maidservants. If they be poor, Allah will enrich them of His bounty. Allah is of ample means, Aware. (32) And let those who cannot find a match keep chaste till Allah give them independence by His grace. And such of your slaves as seek a writing (of emancipation), write it for them if ye are aware of aught of good in them, and bestow upon them of the wealth of Allah which He hath bestowed upon you. Force not your slave-girls to whoredom that ye may seek enjoyment of the life of the world, if they would preserve their chastity. And if one force them, then (unto them), after their compulsion, lo! Allah will be Forgiving, Merciful. (33) And verily We have sent down for you revelations that make plain, and the example of those who passed away before you. An admonition unto those who ward off (evil). (34)
Thus masters were encouraged to marry their pious female slaves. They were reassured that even though these women were poor that Allah can enrich them.
HER IS THE DIVINE COMMAND AGAINST RAPE & SEXUAL SLAVERY
SURAH NOOR AYAH 33:
And let those who cannot find a match keep chaste till Allah give them independence by His grace.
Force not your slave-girls to whoredom that ye may seek enjoyment of the life of the world, if they would preserve their chastity. And if one force them, then (unto them), after their compulsion, lo! Allah will be Forgiving, Merciful. (33
In the first part of ayah 33 Allah Subhanawataala commands the owners to stay off the slave women and keep them chaste till they find a husband.
In the later part of the ayah the admonishment is much more severe for those who force the slave girls to sexual slavery or whoring:
Force not your slave-girls to whoredom that ye may seek enjoyment of the life of the world, if they would preserve their chastity
And then the Punishment:
In the earlier ayahs of Surah Noor the punishment of fornication is outlined as flogging in public of both partners………….Here the slave women when forced to fornicate by their masters with them or others are forgiven, whereas the severely demeaning punishment of public flogging stands for the man (mentioned in earlier ayahs).
This is where as I understand it the punishment of RAPE and endorsing, or participating in SEXUAL SLAVERY is given to the man and not to the woman (especially if she is under his power).
The word of Allah Subhanawataala is strong in the defense of the helpless and the oppressed. In Surah Noor the severe punishments outlined for adultery and fornication are to frighten the men to the point that they think twice before committing a sin of sexual transgression.
Women if forced to “whoredom” or men do not preserve “the chastity” f the women in their power then they are punished in this world and the Hereafter.
